Terms, Conditions, and Policies
Hereby recognize that all the below information is provided by Everdream Events and is current, valid, and enforceable as of May 1, 2021.
Terms and Conditions
I. I agree that Everdream Events or any of its partners, vendors, suppliers, or location management entities are not liable or responsible for any injury, illness, illegal, or criminal activity that occurs activity before, during, or after the event.
II. I agree that Everdream Events or any of its partners, vendors, suppliers, or location management entities are not liable or responsible for any transmission of COVID-19 or any other illnesses spread before, during, or after the event. Everdream Events and its partners work diligently to follow local, county, and state guidelines and adhere to standard health, safety, and cleaning practices. This includes but is not limited to thorough disinfection and sanitization of all equipment after each event as well as additional cleaning during set-up, wearing masks, and wearing gloves.
III. I agree that Everdream Events or any of its partners, vendors, suppliers, or location management entities are not liable for any compensation for said medical or legal situations that occur before, during, or after the event.
IV. I agree that I understand that Everdream Events is not liable or responsible for the actions of its partners, vendors, suppliers, or location management entities. Everdream Events will do all that is reasonable possible to ensure its partners, vendors, suppliers, and location management entities uphold the values of Everdream Events and operate accordingly, but Everdream Events cannot be held liable or responsible for unprecedented actions of third parties.
V. I agree that I understand that all payments for my event are to be made via Venmo at https://venmo.com/EverdreamEvents or via Zelle with the phone number.
VI. I agree to a $25 additional fee if I book my picnic last minute in less than 7 days prior to the event. This fee is to cover special accommodations made by the picnic coordinators for the short notice reservation.
VII. I agree to submitting the 50% non-refundable assurance deposit within 48-hours of my initial booking to secure my event. I understand that this assurance deposit it to secure my event details, including the date, time, location, package, and add-ons. This deposit will count towards the total charge of the event. Thus, for instance, if the total charges of the selected packages and add-ons comes to $250, the 50% non-refundable assurance deposit of $125 amount will be subtracted from the total, leaving a remaining owed balance of $125.
VIII. I agree to submitting the single payment for the 50% non-refundable deposit within 48 hours of booking my event. I understand that the assurance deposit is to be submitted in one single payment and may not be made in installments. I understand that failure to submit the payment of the 50% deposit non-refundable assurance deposit within 48 hours cancels my event booking completely.
IX. I agree to then submitting the payment for the remaining balance up to 48 hours before event setup, but separately from my non-refundable assurance deposit and refundable damage deposit payments. Should any property of Everdream Events be lost, stolen, or damaged, I understand that the full deposit will not be refunded. Should none of the Everdream property of Everdream Events be lost, stolen, or damaged, I understand that I will be refunded the full damage deposit after the event is completed and all items are accounted for in their previously maintained condition.
X. I agree to not leave the picnic setup unattended at any time. I understand that should I need to leave early, unless in the case of a critical emergency, that I am to have at least one person from my party remain at the event setup until the picnic coordinators arrive. I understand that if I leave early it is my choice and there will be no issues refunded for an early voluntary event end time.
XI. I agree to consent to publication and promotion of any locational, photographic or video media of the set-up, cuisine, and add-ons I choose before I arrive for my event. I maintain my rights to deny being present in the pictures, though, as do my guests during the event.
XII. I agree to the travel fees that may come with my event if it is scheduled in a location outside of Anaheim, California. I understand that said travel fee is $1.00 per every 1 mile from Anaheim, CA to my scheduled location. Thus, for instance, an event scheduled 50 miles from Anaheim city limits will add an additional $50.00.
XIII. I agree that I understand that although satisfaction is guaranteed, that guarantee is not made in a monetary form. No direct financial reimbursement shall be issued as a result of dissatisfaction. Instead, a complimentary promotion or accommodation will be offered in the event of dissatisfaction, the extent to which will be determined based on the severity of dissatisfaction.
XIV. Force Majeure.Any prevention, delay or stoppage due to strikes, lockouts, labor disputes, acts of God, inability to obtain labor or materials or reasonable substitutes therefor, governmental restrictions, governmental regulations, governmental controls, judicial orders, enemy or hostile governmental action, civil commotion, fire or other casualty, and oth3er causes (except financial) beyond the reasonable control of the party obligated to perform, shall excuse the performance by that party for a period equal to the prevention, delay or stoppage, except the obligations imposed with regard to Everdream Events and client.
I. I agree that I understand that none of my or my guest’s information, including but not limited to my guests and I’s names, phone numbers, email addresses, billing information, and mailing address, will be publicized without explicit consent. Everdream Events and its partners maintains the highest degrees of confidentiality and respects the privacy of its clients.
II. I agree that I understand that my 50% non-refundable assurance deposit is in fact non-refundable. Cancellation, changes, or rescheduling may still occur according to the below policies, but regardless of the reasoning as to why these alterations occur the assurance deposit is non-refundable but transferable to another date. There will be a $75 flat rate cancellation and re-booking fee.
II. I agree to only having one opportunities to change the date or time, should I need to reschedule my event, up to 48 hours prior to setup, and that is with the $75 flat rate cancellation and re-booking fee. I understand that my event must be rescheduled within 3 months of its originally scheduled date.
III. I agree to only having one opportunity to change locations, should I need to relocate the event, up to 48 hours prior to event setup.
IV. I agree that I understand that further scheduling changes of event date, times, and locations beyond the above-described limit will result in a $75 charge per change. Thus, for instance, if I reschedule my event more than once, I agree to be charged an addition $75 each time I change these scheduling details.
V. I agree that I may cancel the event if needed up to 48 hours prior to set up of the event. Should I cancel any time before the 48-hour mark prior to the event, I will receive a refund of the amount, minus the 50% non-refundable assurance deposit. Cancellation is not encouraged, though, due to the 50% non-refundable assurance deposit.
By Booking, “I agree to these terms, conditions, and policies”, I agree that I understand that I am bound to the above terms and policies, and non-compliance with these terms, conditions, and policies may result in punitive consequence, potentially including but not limited to legal action.
